In this Privacy Statement, Freedom Innovations (“us”, “we” or “our”) wants to inform you about the way in which your personal data are processed when you visit our website (freedom-innovations.com), use our applications (Kinnex and GaitLab), use our social media platforms, contact us or provide your personal data in to us in any other way, wherever you may be based.

When we speak about personal data, we mean any information which directly or indirectly can relate to a natural person. Your personal data therefore refers to any data about you, as far as not completely anonymised.

Freedom Innovations consists of an American mother company, Freedom Innovations LLC, and a European, Netherlands based, daughter company, Freedom Innovations B.V.

The data controller for the processing activities which takes in place in regards our website, applications and social media platforms is Freedom Innovations LLC.

If you are the contact person of one of our distributors or customers which are based in the European Economic Area (“EEA”), it is Freedom Innovations B.V. that is the data controller for the processing of your personal data.

Our website may contain links to other websites which are not operated by us. If you click on a third party link, you will be directed to that third party’s website. We strongly advise you to review the Privacy Statement of every site you visit. We have no control over, and accept no responsibility for the content, privacy policies or practices of any third party website or their services.

  1. The purpose of processing your personal data

Your personal data are processed by us in order to:

  • Allow you to use our website, applications and social media platforms
  • Respond to your message when you get in touch with us
  • Message you as the contact person of one of our distributors or customers
  • Enable us to stay in touch with you when you sign up to receive our latest news
  • Track the usage of our website and adverts for marketing purposes
  • Improve our website and applications

  1. The legal basis for processing your personal data

We process your personal data on the basis of your consent, our legitimate interests or in specific cases, because it is necessary for the performance of a contract.

Consent

When we use your personal data to reply to your message when you get in touch with us, or when we update you on our latest news, we do so on the basis of your consent. Your consent is also the legal basis for the processing of personal data that takes place when we track website usage or process personal data for marketing purposes.

If you prefer not to give us your consent, we will of course respect your choice and not process your personal data. Please note however that we can send you direct marketing messages for similar products and services for which you have already given us your consent. In that case we process your personal data on the basis of our legitimate interest, which is our interest to be able to offer you our products and services which we think you will be interested in.

Content can be withdrawn by filling out our contact form and requesting Freedom Innovations to remove all user information from our database. Please do note that the lawfulness of the processing that occurred before you decided to withdraw your consent is not affected.

You also have the right, at any time, to object to the processing of your personal data for direct marketing purposes, in which case we will no longer process your personal data for this purpose.

Legitimate interests

When we process your personal data for the purpose of responding to your message, or in order to message you as the contact person of one of our distributors or customers in the EEA, we do so on the basis of our legitimate interests. Our interest lies in the ability to completely and adequately respond to your message, or to get in touch with the distributor or customer, which we cannot do without your contact details.

The processing of your personal data for the purpose of enabling you to use our website and applications, and in order for us to be able to improve these services, is also based on our legitimate interests. Our interest lies in the ability to provide you, via our website, with all the information you need on our products and services, to continue to be able to offer a well-functioning website, to improve our website and user experience, and for you to be able to use our applications in the best possible way.

Performance of a contract

If you are the contact person of one of our distributors or customers based in the EEA, your personal data are being processed when we get in touch with you, for example as a result of your inquiry or in order to get back to you with a question about one of your orders.

The processing of your personal data in that regard is carried out because it is necessary for the performance of the contract with the distributor or customer. Please note that if you do not provide us with your personal data, it may be the case that we are not able to perform the contract, for example because of a question which needs answering prior to being able to complete the order.

When you use our website, your personal data are shared with the website’s hosting provider, Network Solutions, LLC (“Network Solutions”). Network Solutions also manages and carries out the maintenance of the website. Network Solutions is part of Web.com, which is listed under the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework.

When you use our applications (Kinnex and GaitLab), your personal data are not shared with anyone.

We love to hear from you via our social media platforms, such as our Facebook or Instagram page. Please be aware that when you communicate with us via these platforms, your messages and its content, including any personal data which you choose to share, will be visible to others including the companies behind those social media platforms.

When you get in touch with us or we get in touch with you

In order to be able to respond to your message, the personal data we receive when you get in touch with us are only shared with the Freedom Innovations team solely to respond to an inquiry.

To enable us to keep you up to date on our latest news when you have signed up to our mailing list, we share your personal data with strictly the Freedom Innovations team solely to respond to an inquiry.

If you are a distributor or customer based in the EEA, your personal data is shared with strictly the Freedom Innovations team solely to respond to an inquiry.

On the basis of a legal obligation or a court order

If a legal obligation or a court order obliges us to disclose your personal data to a third party, we will need to comply and share your personal data with that third party.

Cookies

When you accept the cookies on our website, your personal data is shared with Google, ShareThis, Inc. and Youtube.

  1. The storage periods of your personal data

When we process your personal data in light of your use of our website, our applications or our social media platforms, we store that data for as long as is necessary for you to be able to use the website, the applications or the social media platforms. When you no longer use either of these, we will erase your personal data. Please note that a legal obligation can require us to keep the data for longer.

The length of time we store your personal data after you have gotten in touch with, depends on the time that is needed to respond to your message adequately and completely. Once you have received a reply from us and there are no follow-up messages from you, we will erase your personal data.

If you have signed up for our mailing list, we will store your personal data until you withdraw your consent by opting out of our mailing list. An exception applies when we send you direct marketing on products and services which are similar to those for which you did provide us your consent.

Should we have received your personal data through the sales of similar products and services to those to which the marketing refers, we do not need your previously given consent. You can always opt out of the direct marketing as we will give you the opportunity to do so with every such marketing message we send you.

  • Contest the accuracy of the personal data, in which case the processing can be restricted for a period which allows us to verify the accuracy; or
  • The processing is unlawful and you oppose to the erasure of your personal data, requesting restriction instead; or
  • We no longer need the personal data for processing, but you require the data for the establishment, exercise or defence of legal claims; or
  • You invoke your right to object to the processing, in which case the processing can be restricted during the time that we verify whether your legitimate interests are overridden by our own.

Data portability

Where we process your personal data based on your consent, you have the right to receive the personal data which you have provided us in a structured, commonly used and machine-readable format. You also have the right to transmit those personal data to another controller.

Right to object

When we process your personal data on the basis of our legitimate interests, you have the right to object. We will stop processing your personal data, unless we can demonstrate that, on a balancing test, there are compelling legitimate grounds for the processing to take place or the processing is necessary for the establishment, exercise or defense of legal claims.
